What happens to the child if the Mother (or Father) gets arrested while they are out with the child alone?

  • And this is completely hypothetical! lol. I have always wondered what happens to the child if they are out and about with only one parent and that parent got arrested. For example: (and again, completely hypothetical!) What if my son and I were at the park, just the two of us, and an argument broke out between myself and another Mother; one thing leads to another and her and I are in a fight (hitting, slapping, etc.) and the Police show up and I get arrested! (or she gets arrested!) What happens to our kids? Do the Police call the other parent to come get the kid? Or does the child immediately go into Social Services (and get placed in a home)? And this question isn't like for drug dealers or drunk drivers (pre-meditated crimes) .. this is strictly if something totally random happens (like an unpredicted fight with someone else) and the parent gets arrested (this is not a question about what happens to the child if the child is living in a bad environment or abuse or any of that, this is just strictly asking if the child is with the parent and the parent gets arrested for some random act that was completely unpredicted)? - мaяк's ωifee -

    As a police department employee this is how we do it... If there is a child with the parent in the situation that the parent gets arrested we attempt to make contact with another adult whether it be the other parent or family member/friend that can come get the child. Usually the parent being arrested makes this choice assuming they are capable of making the choice. Sometimes the officers have to bring the children here to the police department and wait for the parents/guardian to show up and get the child. If we spend a reasonable amount of time attempting to make contact with someone and are unsuccessful we will then contact our on-call social services and have them respond to the police department and start up the paperwork. For example: Several months back we had an officer pull over this guy. Turns out he was drunk and the child was not properly restrained int he vehicle. We had a very difficult time reaching the mother (this was her boyfriend that had the child). The Sgt brought the child, probably a little under 2, back to the PD. We FINALLY made contact with the mother at work and she responded as quickly as she could. Of course the SGT was pissed and threatened her that if she didn't get off work her kid would go to social services but that's another story. We do our best to NOT have these children go in to the custody of the state if at all possible, but we can't babysit all night or day either, but we had to one night when some crazy lady from out of state got arrested and we had an officer wait on post for 6 hours for the father to come up from Alabama to get his son. **Oh yeah, and the poor little girl up there had NO diaper bag so we have no idea how long she had gone without a diaper change or food. Part of the reason we got on to mom to get her bum down here asap.

In your hypothetical example your hypothetical mother should get hypothetically slapped again. hahaha. I honestly don't know, but I would assume (&you know what they say what happens when you assume)... but I would ***.u.me that they would call someone to come get the child like they call someone to come get a car if someone is drunk driving??? I should also say I don't know that is what happens when you are drunk driving, I thought I saw it happen once.

The police would probably ask you if you have any family or if the child's other parent can come pick the child up.

The parent goes to jail and the child can be placed with social services or with relatives. That what happened to my older brother when he was caught selling bootleg DVD movies from his car to 2 undercover cops and he had his son with him. My mom went to the police station and got my nephew and stayed with her til his mom came from Iraq.

I have no idea but my guess would be that the othr parent does get called, or a grandparent or friend, otherwise they would probably just go to the copshop with you. My boyfriend got arrested (and was found innocent BTW, his ex made false allegations) but all that happent was hewent down town, hd his fingerprints taken, was asked a few questions and then came home on bail, if he had our daughter with us she wouldn't havebeen in the way, it just wouldn't have been an ideal situation.

it depends really most of the time they will aks you to first call someone to pick up the child...police do not want to see a child go throught that and it cost tax payers alot of money....so most of the time they go with someone if you do something so bad that you are a unfit mother then they take them and call no one

Your (or her) child would be put in the "system" but not necessarily put in a foster home till it was determined that the mother was unfit and there were no next of kin to contact.
