Can Child Services take a child because of the child not looking like the parent?

A good friend of mine and distantly related by blood to me is the parent of a bi racial child, shes from India and her husband is Irish/Italian. Hes hardly at home - he travels alot for his company. Her child takes after her husband and looks nothing like her. The child is four and attends a pre school summer program. Two of the teachers there are convinced that her child is not her own or that shes the nanny and pretending shes the mother - which is the most dumbest thing I have heard. I actually was present once and heard the teacher refer to her and I as the nannys. I think the misunderstanding could be that her husband was the one to sign up their child and the teachers and staff never have see them both together. However in the contract -she is listed as one of three people that is authorized to pick up the child from the program -I'm not sure if its listed if shes the mom or not. I know they have checked her ID mutliple times and see that she has the same last name as her child. She verbally told them she is the mother, she gave birth to her child and her husband had called to reiterate that fact. After a month of this she pulled her child out of the program and enrolled him into a similar program. Yesterday a parent that she had befriended had overheard that the teachers were able to get an administrator of the program to call child services to investigate her. My questions are, can social service investigate her because of her and the child not looking the same? Can social services even act on that type of complaint to begin with? Can she sue the teachers or report them for gross misconduct? What is likely to happen? Will Child Services call her, visit?

There is a chance that Child Services could pay them a visit, but if she is indeed the child's mother, then yes, a lawsuit will be involved. I hope these teachers get dismissed, and the school gets sued into oblivion. While they may think they are looking out for the welfare of the child, all they are doing is making the child's life worse. Taken away from a caring family to be put in a group home, putting unneeded stress on the parents, and sticking their nose where it doesn't belong especially when they clearly don't know the facts.

Child services has an obligation to follow up on all complaints. They may call or show up. I wouldnt worry to much as long a she really is the mother. They may just pull the birth record of the child and eliminate the conplaint

My husband works for CPS and they will not take away children for not looking like a parent. If there was a report called in then the most they will do is pay the family a visit but it probably won't even come to that unless the teachers reported some sort of abuse or suspension of abuse. CPS is simply there to protect the children, not to answer every annoying call that comes in regarding a child not looking like someone they should. Your friend will not likely be able to sue the school or the teachers. Anyone is entitled to call in a report with out the fear of getting in trouble as long as they have a true concern and are doing it in good faith. (Even if the concern is really stupid like this one.) Not to mention, it would just be hear say that these teachers were the ones to call in a report. (CPS will not disclose who called)

No they can't. You could have brown hair, brown eyes, and darker skin while your child has blonde hair, blue eyes, and pale skin and that does not mean that they aren't your child and that you didn't give birth to them. As long as she shows them the birth certificate they can't go against that because that is solid proof that she is the birth mother. What dumb asses to say that. I hope everything turns out ok for her.

No they cannot and this is ridiculous. If the teachers are going to call CPS I guarantee they have a better cause than the "ghetto paternity test". falsely making claims against parents would be one quick way for them to be sued, lose their accreditation, lose future membership, etc. In short, it is NOT in the schools best interest to make random false claims on the parents.
