Costa rica immigration question?

I have a friend that is married and has a baby in Costa Rica she is going threw the immigration process they told her that everything is fine except when she applied her visa was expired at the time and still is expired by three years. There is a new law that if you stay longer then three months you must pay 100 dollars for each month that you are expired or yu will be banned for a certain amount of time when you try and come back into the country. Will this apply for her since she is already going threw the process with immigration when she comes back over the boarder back into Costa Rica? Immigration told her she has three months to renew her passport. She also started her immigration process before this law took effect.
