Can a person hold H4 and UK student visa at the same time?

• I am currently on an H-1B visa with my wife in US. She also has H-1B. She is planning to study in UK for next one year and has got the admissions. So she will be leaving US and will be taking up the UK student visa. My question is while she is on a UK student visa can she also hold a valid US H-4 so that she can enter and exit US without any kind of hinderence normally or in case of emergnecy?

  Yes, she could. If she quits her job as an H-1B, she is no longer entitled to that classification, but as your spouse, she's entitled to the H-4 classification. The fact that she wants to attend school in another country does not disqualify her for an H-4 visa. She is under no obligation to spend all her time in the U.S. as an H-4. There is no requirement that she be in the U.S. a certain percentage of the time. If she has something worthwhile and important to do in the U.K., that's great. It would not make her inadmissible as an H-4 (as long as you're still the H-1B).
