How does my student visa effect my spouse visa?
-
Im a student from srilanka in UK, and recently got married to my girlfriend(who is a british citizen), now I would like to change my status to spouse visa from student. My college has probably informed me to UKBA of my poor attendance to the college, but I havent heard anything from the college nor UKBA regard to this matter. how would this effect my application for a spouse visa??

Answer:
If your student visa is revoked, which it will be if your college reports you, then you cannot change to a spouse visa but will have to leave the UK and apply from Sri Lanka. Your best bet is to return to your studies if your college will let you until you have applied for and received your spouse visa. Otherwise you will have no option but to return home. You can only change your visa status or extend your current leave to remain if you are legally in the UK. Edit. Ignore the poster claming to work for UKBA. From other ridiculous answers she has given it's clear she knows nothing about the subject.

Based on your poor attendance in college, you didn't maintain your student visa status and now you are getting married to UK citizen. Immigration officer would consider that you only married UK citizen to stay in UK when you apply spouse visa.

If it's anything like the states, then you'll have a hassle adjusting and you'd possibly be put into removal proceedings for failure to maintain your student status. Quickly marrying a citizen while they're considering removal only makes it worse and prolongs the matter. Not that it's impossible, but it costs a lot of time and money just to prove that your marriage is based on love and not immigration. That's in the States and since our legal system was heavily influenced by the Brits, I'd imagine it's similar there as well. Bottom line is that you're in for a rough time proving that your marriage is a genuine no matter what country you're in, based on your scenario. But who knows? If you couldn't keep your student status because you were too busy working to pay for the wedding, I'd probably let ya stay and not push it. Love and marriage happen.

To be more precise i have been go in out with this girl for more than 5 years, even before I came to the UK. Even if this go in to be a problem, what should I do in order to get it sorted? RETURN to Sir Lanka and apply for a spouse VISA. Sounds like you would be wasting your time trying to continue with your studies. To far behind. College only report people not attending if you have missed months of your studies.
