What is an I-20 Visa?

What if student had problems till date and now he needs a new I20! help! 5 years on visa in US!!?

  • I20 is out of status from last 1 year. What are the chances that if the student applies for new reinstatement he will get I20 or it will be rejected.. Only reason we can tell is: the problem was with money and his tuition. .what are other options.... ... .. except leaving. He has almost paid $110,000 for his college with last year left in Grad. He was here on a visa for consecutive and got his new I20 valid till 2014. Jan.

    A requirement of a student visa is that you have sufficient funds for all school & living expenses plus return transportation to country of citizenship. If he ran out of money & could not pay his tuition to register for another term in school, he had to depart immediately. He probably could have transferred his credits to a school in his own country toward graduation requirements there. He has NO choice now but to return to his own country. Since he overstayed a year, he is barred from reentry to the US for 10 years. With a record like that, most countries will not issue him any visa - countries share info & do not grant visas to those who violate immigration laws and/or visa regulations. He's going back to China and remaining there. He had better plan on remaining permanently in China - his record of visa violations WILL cause him problems & visa denials, probably for the rest of his life. He really fouled things up badly. And if he was working in violation of visa terms, that's another visa violation which will prevent his return. If he failed to file income tax returns & pay taxes, he not only has immigration on his tail but the IRS as well. That's definitely dangerous! Get out of the US immediately and do not attempt to return!

it doesn't matter what his chances are. this is his only choice if he wants to legally stay. so, either he tries this, or doesn't and becomes illegal, or leaves.

Usually grad students get tuition support from their college or out of grant from the adviser if they are any good - and if they work in a reasonably well funded field (don't know if that was the case). The first question I would ask is why that student did not work with his/her graduate school to resolve the issue when it occurred and why that student wasn't working with the international student office before things got so far? Usually final year graduate students can find some financial support if they are any good and well liked in their department. At the very least there are usually some teaching jobs floating around even a not brilliant graduate student would get with priority if their graduate school knows they have financial trouble. There is even the option of getting permission from the school for working outside the university (CPT). It's only worth trying to fight for staying if that person has enough support in the graduate program that they want to help that person graduate. So the first question would be how the academic achievements of that student were and why the student couldn't resolve matters earlier. If performance was failing or borderline passing then there is no need to throw good money after bad. Without great academic credentials the chances of finding an employer to sponsor that student for a work visa are very low anyway, and the student has to return home. The chances of reinstatement are very low anyway. edit: well, if it is one of the more impersonal programs and he is only one year into Masters but got a degree out of the whole thing, then he can go home with his bachelors degree. Without sufficient finances he shouldn't have started on a Masters, but work for a while first. A student visa is very clearly a non-immigration visa, there is no implicit right to stay. It's not like he didn't know the situation up front.
