Why would the USCIS deny my application?

About I-140 application?

  • I have a question: after sending the documents about I-140, sometime, USCIS will ask REF. I wonder if I am not asked to send more supportive documents, so that mean my documents are strong enough to support my I-140 application? Before USCIS deny your case, will they give you a chance to provide more information? Thanks.

  • Answer:

If the USCIS require more documentation then they usually will inform you with an RFE (Request for Further Evidence). If they do not, then they will just return your application, documentation and your check with an RFE and then all you do is re-file the application with the additional evidence which they ask for. Just remember that the I-140 is filed on behalf of the applicant and not *by* the applicant.
