Can I apply ILR without any problem?

ILR query & information (UK)?

  • Hello People, I need some information regarding ILR. I am due to apply for ILR soon. Initially i was granted 60 months WP and my visa got stamped on 9/2/2007 and arrived in UK on 19/2/2007. When does my 5 years start from? 9th or 19th? I worked for the company for about 12 months and then I changed my employer. I was issued a new WP for another 60 months from 2008 onwards while I was in the UK, so will my 5 years get counted from 2007 or 2008? Also, my new visa got stamped after 3 months of my new employment while in the UK, is that a problem? Also my second job was under a different job title compared to my 1st job. Will this have a effect on my ILR application? Thing is, I have been in the UK since 2007 under full time employment between two employers (2 different job titles) with no breakage in the visa status. Please let us know soon, your help will be much appreciated.

  • Answer:

The five year waiting period starts fom the date you have actually entered the United Kingdom [19/2/2007]. You can apply for ILR up to 28 days before you become eligible, hence you can apply for it right now. http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/ ..

The date starts from when you entered the UK (19/2/2007) the requirement is 5 years living without need of support, living and working in the UK so any number of employers is fine. While changing a visa, the old visa remains valid, even extended if it had expired, while making a new application. So you have no problems as the previous visa would have remained (and your legal status) while applying for the new visa. You can apply 28 days before 19/2/2012 (5 years after entering), or any time after, there is no time limit except that you must be in the UK on a valid long term (i,e, not student or visitor) residence visa at the time of application. So you have up to the end of the 2nd visa to apply. see SET(O) http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/applicationtypes/ http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/applicationtypes/applicationformset(o)/ - completing SET(O) guides
