How to move to the US?

How long do I have before I have to move to the US after receiving my greencard?

  • I am an Australian citizen and have received my greencard in Jan 09. My husband (US citizen) and I went over in Jun/Jul09 for a couple of weeks to "activate" my greencard. We are now back in Australia and planning our permanent move to the US in April 09, which means it will be more than 180 days since I have been there, but not a year. I know that they "red flag" you for abandoning the status if you leave for more than 180 days. But what does that mean exactly? Would immigration accept my situation (e.g. that we have just taken a bit more time to move to the US permanently) as a valid reason for being away for over 180 days? Or is there a risk of me losing the greencard? Also, would traveling to the US prior to the 180 days for a quick visit be a guarantee that I'd be ok (though I want to avoid having to do this as we have 2 small children...). If anyone knows about this or has made the experience, please let me know!!!

    You are safe up to a year.. but they do expect LPR to be resident ...
