Can my wife sponsor me to get my papers?

my wife wants to try and sponsor me to get my papers since i came from mexico when i was 2 years old we have been married for 6 years now and we have a baby boy am now trying to get my papers in order for our family to not be separated my question is can she sponsor me even though she is reciving help from the goverment she recives the link and some cash assistance until they find her a job will this affect the process or should i continue and try to get my papers also does anyone know a good lawyer in chicago that has actually brought some one back and that does now charge a arm and a leg so far i found guys that want 4,500 4,000 3,800, and that last guy wants 3,500 but none have been able to give me a solid anwser to what am looking for please help thanks

She can't sponsor you if she doesn't work and especially not with government assistance. Have her find a full time job and once she is making enough money where the government thinks she can support you on her own they will let her sponsor you. You will have to live in Mexico until they let her sponsor you and come back when the process is over because if you get caught living here before becoming legal there is like a 5 or 10 year period until you can come back. My boyfriend's from Guatemala (came over at 16 & his dad was his sponsor) and his uncle is going through a similar situation. His uncle recently just got his citizenship and wanted his girlfriend to be legal and not have to worry about her being deported because they were living together over here for the last 8 years. In order to make it legal they got married and now shes staying in Guatemala until Christmas (that is when she is allowed to live here).

Bad news. Your wife can file an I-130 petition (for an alien relative) for you with the USCIS. It costs $420 and takes about 5 months to be processed. Thereafter you will have 2 problems: 1) Your wife will need to provide an Affidavit of Support for you. Basis for this is her latest income tax return. So if it's just she, you, and the baby, you have a household of 3 people. The minimum she needs to make after taxes is $23,162 http://www.uscis.gov/files/form/i-864p.pdf That's the small problem, as you guys could find a co-sponsor. The big problem is this: 2) You will need to leave the U.S. to attend the mandatory interview at the U.S. consulate in Ciudad Juarez. But when you leave the U.S., you will trigger a 10-year bar for unlawful presence of 1 year or longer. The clock started ticking when you turned 18; before that it was your parents' fault, from age 18 on it started to become yours. This would mean that you and your family need to live in Mexico for 10 years, before you can come back. Now . . . here's the tiny little light on the horizon. a) I'm quite sure that in late 2013 or early 2014 the DREAM Act will become law. You would qualify, but you would need to go to college for 2 years or join the military. Since a decent career and income is the key to happiness, doing community college part time after work is probably a good idea anyway! b) There's a waiver available for this 10-year bar, the I-601, but it's friggin expensive and too complex to explain it to you right here and now. What matters is that President Obama has indicated that he wants to change the waiver process, so that you would be able to apply for it while still in the U.S., and then only leave when you have the waiver in hand. That way you wouldn't stay outside the U.S. for longer than a few days, perhaps a week or two. Again, we're talking proposals yet, nothing is going to happen this year before we vote for the next President in November.

She will need a co-sponsor when she petitions for you. How can she show she can support you when she can't even support herself. Marriage and a baby does not change your status. After she petitions for you, you will have to go back to Mexico to have your interview. At that point you will be denied and given a 10 year ban on returning. She will then have to file a waiver if she can prove extreme hardship without you here. You must remain in Mexico until you are given permission to come back. Could take up to a year if the waiver is approved, 10 years if it is not.

The problem is that she will have insufficient income for the required affidavit of support. This could be overcome if she has a co-sponsor willing to help.
