What is a petty theft?

F1 Visa cited for Petty Theft, what should I do? what will happen next?

  • I am 28 yrs on F1 Visa in California. on Feb 2, 2012 i was caught leaving JCPenny with an unpaid item worth $12. I am cited and released and have to appear before a judge. This is also my first offense. i can not afford to pay a private attorney and am thinking of standing alone by a judge. What am i suppose to say? Will i be removed from US and stripped of my F1 Visa? Will they inform my school about this incident? will they allow me to walk away with just disorderly conduct? and have my petty theft off the record.

    a single act of shoplifitng really won't cause that much of a problem. but it's two strikes with this so don't do it again or you will find yourself on your way back home. didn't anyone ever teach you never steal anything small? do you really want to risk your academic standing and future for some $10 item? will they tell the school? who knows? will they allow you to walk away? maybe. however, these are questions that were better asked before you walked out the door. keep that in mind in the future.

For starters, you shouldn't be a 28 year old F1 unless you were pursuing a higher degree in something useful. And you weren't because at 28, you've had 6 years of post graduate education so you'd be a doctor, attorney or scientist by now. And Doctors, Attorney's and Scientist don't shop or steal at JC Penny's. Go home. The U.S doesn't need any more petty thieves on their hands. GO HOME and STEAL FROM THERE.
