Overstaying on a tourist visa?

  • Hello everybody I would like to ask this, I enter to the USA on 2001 with a tourist visa and I overstayed for 4 years, I also had a baby in USA, now I been in Mexico for 7 years, but when I left USA I left by plane trough San Diego, and when I entered to Mexico they stamped my passport on Mexico immigration, my question is? do you think I have the chance to get another tourist visa?

  • Answer:

existe only one way to know about is trying do it just apply.. anyway if you want to go to usa agian you must need apply for a visa so do it. .But once they didnt get you in immigration. think they dont know about you you are clean (*) But think your name is in the files teher dont know exact becouse. many changes and this goes a long years .. think you re clean . just do your the best and have the proper papers to aply again. be sure you have all they want.. if you want bring your son/daughter. you must prove you want go back to your country or to mexico >? .. you need a strong support that you ll return to your country this " is the matter ' if you have apply if not please try your the best to reach all papers they want to give you a visa.

Oh hell no....once you overstayed your tourist visa thats it...you cant get another tourist visa

technically speaking...Your under a 10 year ban from the United States that mean no new visa can be issued to you until it's removed. apply in 3 years time... your visa will likely be denied.

No you are banned for 10 years then you can apply ..but will probably be denied

I hope not. You have proven yourself to be dishonest and criminal. Why should you be allowed to do it again?

If you overstayed, you got a ten year ban. So in 2015 you can reapply, but your visa would likely be denied because of your last overstay, because you lied on your visa last time since you came to have an anchor baby and not for tourism. Its kind of hard to hide it, being you likely got a US passport for your anchor baby and you probally never turned in your paperwork when you left.

Regardless of which story is actually true, you won't be re-entering the US until your child moves to the US as an adult and petitions you for an immigrant visa when he or she turns 21. Your passport was scanned either at the airport in San Diego or by CBP in Tijuana. Regardless of what you did with yoru I-94, your overstay is recorded in your travel history, so your tourist visa is cancelled and you probably won't ever get another since you've already shown that you think having a tourist visa gives you the right to live and work in the US. Hope you at least paid the hospital bill and didn't sponge off Emergency Medicaid.

If you overstayed your tourist visa, then you are banned from entering the USA for 10 years. Even after that, you'll never be approved for another tourist visa because they will think you are going to overstay that one too.
