How to apply for a fiancee visa in Germany?

Can my fiancee live in the US with me while we apply for a K-1 visa?

  • I am planning on proposing to my girlfriend when she comes to visit me over the holidays. Would she be able to stay in the US with me through the application process for the K-1 fiancee visa or would she be forced to return to Germany for the duration of the application process?

  • Answer:

The short answer is no. She can stay with you for up to 90 days if she uses the visa waiver process but will have to return to Germany for the interview. In fact if she stays for the whole 90 days she may be delayed in getting her interview if her case is processed quickly. If she stays in America too long with you then she risks being refused a visa as an overstay will trigger a ban from the USA. Go to http://www.visajourney.com for plenty of free advice on the whole process including specific information about the interview in Germany. While she is visiting you make sure you take some pictures of the two of you to help with your application, firstly to prove that you two have met, and then some she can use at her interview to show an ongoing relationship (pictures of both of you with your family and friends are good for this) The separation is lousy but it doesn't really take that long, my K-1 was done in just over 5 months and if I had been more organised with the papers I needed for the embassy it could have been even quicker.

the K-1 is a visa intended to bring fiancees INTO the US upon issuance of the visa itself....she would have to attend a interview in the US consulate of her home country. So, the answer is no....do yourself a favor and follow the rules...it can backfire on you if you dont....she should return to Germany to do this right...K-1 visas usually take 6 to 8 months...here is a link for requirements on the K-1 visa: http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=716d596f22c3579a6329b1528545bce4 good luck!

It took almost 2 years for my daughter in law to get hers after my son went to Pakistan and married her.The embassy has to do a background check, she has to have a physical, ect, ect. It is a long drawn out process that is not made any faster when you're dealing with the Federal Government. Good Luck!!!!!!!!!
