Can you still get your US visa if CHARGED with not filing city tax but NOT CONVICTED?

My husband and I are new at this whole tax ordeal, My husband has been in the country trying to renew his visa we are 6wks away from the big interview, well last week we were summonsed by the City to the court for not filing or paying last years city tax, it expired 4/15 i had no idea when i had to do this, we got on a diversion program but our lawyer is trying to tell us that she is afraid when we go for the interview they will deny his allowance to stay in this country, with a new family starting this really puts us at a stop, we dont want to raise our son out of the US, please help?
