Why would the USCIS deny my application?

F-1 OPT application question?

  • I am graduating with a Masters degree and will be applying for EAD using the F1 OPT option. I applied and was granted EAD when I graduated from my Bachelors degree a couple of years ago. I know that I will have to submit a separate application to get the new EAD. When reading the instructions, it asks to submit a copy of my previous EAD if i applied for and was granted one. The problem is that since I never used my previous EAD, I never kept up with it and I have lost it. Do I have to submit a copy of the EAD to USCIS? Will they deny my application if I don't?

  • Answer:

    Simply add an attachment to your I-765 explaining that you no longer have your old I-765. Honesty is always the best policy. However if you do have anything remaining from your old EAD application such as your OPT card, NOA1 or even your approval notice and add that in with your attachment. If you have nothing, then don't worry about it. Just file the application, with the Form, attachment note and all other required documents.
