Immigration marriage interview story. Share yours?

  • My husband and I just passed the dreaded immigration marriage interview. I am so happy and I want to share my experience for all the other people going through this. Please share your stories. Our appointment was at 8:30am, so we made sure to get up very early and eat breakfast. We were dressed in business casual attire. We arrived at the Memphis branch of DHS at about 8:15 and were not called in until about 9:10. The officer brought me in (without my husband) with the lawyer. He was very serious, but not rude or mean. First, he made me swear to tell the truth and then he asked for my drivers license. He asked me basic questions about my address, social security number, job, how I met my husband and if I had any financial evidence for our marriage. Then, he brought my husband in the office with us and swore him to tell the truth. The officer asked him some basic questions (name, address, etc) and then started asking about his first marriage. He asked to see the original divorce certificate with translation. He spent about 15 seconds looking at our pictures and then asked to see my birth certificate and the marriage license. Then he told us that he was going to give us a notice of approval. Our lawyer asked him some more questions about writing something so that we could get the removal proceedings terminated. Honestly I didn't pay attention to anything after I heard the word approval :). We were getting in our car to drive home at 9:40am. We had brought records from our joint bank account, health insurance, life insurance, car insurance, a joint furniture loan, doctors visits receipts , 5 affidavits from friends and family, and 3 years worth of phone records. The lawyer put all the documentation together in a nice neat package that we could give to the officer and it looked very neat and professional. We also brought 3 photo albums full of pictures and had done 2 fake interviews with our lawyer prior to the interview. I think our interview went well because 1) I love my husband and our marriage is real, 2)we had a ton of evidence, and 3) we had a good lawyer that told us what to do. Some people might say that an immigration lawyer is too expensive and unnecessary. We chose to get a lawyer because my husband was in removal proceedings when we got married and he is from a "high-fraud" country. In my opinion, a GOOD lawyer is worth their weight in gold and it doesn't matter how much they charge. I think immigration officers treat you better when you have a lawyer because it shows that you have the financial resources to afford one. Just my thoughts. We still have a long way to go, but we are past stage one. Good luck to everyone going through this very tough ordeal. Here is our timeline: July 2004- Future husband arrives in USA with J-visa July 2005 - Future husband overstays visa and does not return home Dec 2008- Met future husband April 2009 - Exclusively dating future husband Nov 2009 - Moved in together with future husband April 2010 - Future husband was arrested by ICE and put in removal proceedings April 2011 - Married husband August 2011 - Filed and sent petition for I130 to DHS August 2011 - Removal proceedings suspended by immigration judge until April 2012 Jan 19, 2012 - Received invitation from USCIS for interview for February 27, 2012 February 27, 2012 - Passed interview!!!!!!!

That's because he overstayed. If he had just crossed the border illegaly he would be given a 10 year ban.
