From uk student visa to uk spouse visa?
-
My husband (since 1month) is british citizen by naturalisation (originaly from the same african country as me). We got married after almost 2 years of relationship in the uk. We are getting prepared to switch my student visa for a spouse visa but are a bit worried about the financial requirements. - We have 2500£ in a joint saving account, 2000£ in hubby's current account and like 1000£ in my current account. He studies and works part time (like 400£ a month). I was on a permanent contract before the regulation changed and student are not able to work now. So I had to terminate my contract. We are planning to show I can earn money with my past pay slips (in average 600£ a month). Do you think that's enough? - We are renting a room in a decent flat but there are 3 other rooms. We a re not sure if that's ok for UKBA. - We are planning to apply for the same day service. Will my husband be with me at the interview? Do you think we have chances?anything you think we should include as well? We will really appreciate if you could provide any guidance. Thank you! :)

Answer:
Current income guidelines are you need to have at least £105 per week left over after rent, council tax and utilities. Any savings can be counted as well. You will need a copy of your rental agreement. If you are not already on the lease, then a letter from the landlord stating you can be added. You need at least 6 months left on the lease. You need bank statements (the actual statements, not print offs) for 3-6 months. Any wage slips for 3-6 months. Marriage certificate. If either of you have been married before, divorce decree's. If you (the immigrant) has any kind of criminal convictions, including driving infractions, you will need proof of these, and that they are resolved. If it is a driving infraction, a copy of your full driving history. Your passport. Your husbands British passport or naturalization papers. It has always been students could only work 20 hours a week. This has not changed. I don't know what you mean by " student are not able to work now". If you have worked more than 20 hours per week whilst on your student visa, during term time, then you need a immigration solicitor to help as you have violated your student visa.

Yes your husband can be with you at the interview. The interview is quite straight forward and providing you have all the documentation with you, then you have little to worry about. They simply want to see that you have money in your accounts and that you are earning enough to live on without resorting to benefits, which you will only become entitled to once you are granted indefinite leave to remain and take the life in the UK test, and you become a British citizen. The total amount of savings is not a big issue. You need to prove that after all your expenses, you still have about £150 to spend per month. Once you have your spousal visa, you will be entitled to work full time without restriction, but you will not be entitled to benefits. Just be sure to take ALL the documentation that is required with you on the day, as you will not be refunded the fee if you do not have what they need. You should be fine, it's not as bad an experience as you may imagine. Most of the time is spent on sorting out your ID card.
