US Passport expired, can I use my UK Passport to travel to the Bahamas even though I reside in US?
-
I have dual citizenship and 2 passports. My US passport is expired and I don't feel like going to the trouble or expense of renewing it before I leave for the Bahamas in 3 weeks. I am US born and reside in the US but as my mother is a citizen of the UK, I have citizenship. If I use my UK passport to enter the Bahamas (a friend who lives there assured me this would not be a problem), will I have trouble re-entering the US? What is the process?

Answer:
Get your passport renewed prior to travel! 8 U.S. Code §1185(b): Except as otherwise provided by the President and subject to such limitations and exceptions as the President may authorize and prescribe, it shall be unlawful for any citizen of the United States to depart from or enter, or attempt to depart from or enter, the United States unless he bears a valid United States passport..

US citizens are required to enter & exit the US on their US passport. You need your US passport to leave for the Bahamas, and you need your US passport to get back into the US. Since you are US citizen, you have no US visa in your UK passport. Try to use that when leaving the US for Bahamas and you could have serious trouble. Of course, you cannot get back into US without US passport, either. Renew your US passport or cancel your trip. You are not going anywhere without it.

Yes, we as US citizens need to have a passport to return here. It used to be just a birth certificate, but now you need a passport. I would apply tomorrow and get in expedited if you want it in time for your trip.

Yes, you can do it. But it doesn't look right. Think about it . Quite dodgy.

As a U.S. citizen you are required to leave and to enter the U.S. with a valid U.S. passport. If you use a U.K. passport, you are guilty of material misrepresentation as a foreign visitor (when you are in fact a U.S. citizen) to a federal officer. That's a crime, plain and simple. Not sure if they would lock you up, but the fine will definitely about 15 times what a shiny new passport will cost you, plus about a grand for your attorney. You can get a new passport within 3 hours at the nearest passport agency. I got mine in 170 minutes. Still cheaper than a date with a judge and risking being disbarred and much less hassle than having a criminal record. But that's just me.
