I am illegal here in the US and getting married to a uk citizen. How can i get a spouse visa to uk?

  • i came here july of 2003 and was given the chance to stay for 6 months on a tourist visa. A few months after i met a guy and got married a month before my visa has expired. He filed for my petition a week after we got married. But things didn't work out after living together for 2 months. So, i left and he cancelled my petition. Since then, ive been living in the US as an illegal alien. We got divorced in 2004 and would like to get an advice regarding a case. As i am getting married with my present bf who is a citizen in the uk and physically lives and work there. We would like to be together in the uk. But we are not sure how things work with the immigration. We are planning to get married here in the New york. He will take the marriage license to the uk and file my petition there. We're not sure if this will work. That's why im seeking for a professional advice. We just want to know the fastest way of us being together as a married couple in his country. And also, if im still gonna be able to visit the US after i leave? As my family lives here.

    The United Kingdom does not operate a petition system. You must apply for a settlement visa as spouse of a British citizen; your application must be backed-up with appropriate documentation of your British spouse that he has sufficient funds to support you in the UK without making use of public funds and that he has sufficient space to accommodate you. You also will need to pass an English test if you are not a citizen of a majority English speaking country. The visa application can only be made from the home country or the country of legal residency. An application from the United States is not possible. Gerd gave you a perfect answer. I'd just like to add that once you have left the U.S., you will never be able to come back as long as you live, except as the spouse of a U.S. citizen. For all practical purposes, the U.S. consulate will never issue you a non-immigrant visa to the U.S. again, not even after the 10-year bar has been served. The 10-year bar is only a "hell no" first step. After 10 years you can apply for a new visa like anybody else and will be denied like anybody else who had been barred, deported, or overstayed their welcome significantly.

You have to get married in your home country in order for him to bring you to the UK. You cannot do it from the US because you are illegally here. You won't be allowed back to the US for at least 10 years because of your illegal stay.

You cant. You can only apply for a UK visa from a country where you are legally resident as part of the documentation you need to submit is proof of your legal status in the country you are applying from. The UK will not grant any type of visa to an illegal immigrant in another country and an adverse immigration history in any other country will make you highly unlikely to be granted a visa in any case. You will have to return to your own country to make a visa application. Your b/f cannot petition you or make an application on your behalf.
