To discuss my case in a even deeper manner I want to provide you with some additional information and hope this will make me able to get an even deeper view of my personal situation. How to get a H1B Visa / Security License Series 7? Hello, I am currently on a J1 Visa and work for a Financial Consulting Company in the U.S. Since my current company offered me a job position as a Financial Consultant I try to figure out my chances to obtain a H1B Visa. I am 23 years old an hold a Bachelors degree in Business Administration / Finance from an European University and my degree is equivalent to a U.S Bachelors Degree. The Job Financial Consultants also falls under the list of Jobs in special occupations. Since my Company wants me to get my Security License Series 7 as well as 66 they registered me with our broker/dealer. I will take my Exam within the next 90 days. Since the Visa Cap is a huge issue we want to file petition for my Visa as soon as possible. Is it possible to file petition for my Visa before I have the Series 7? How are the Chances to get the H1B Visa and start working for my company? Does the H1B Visa requires the Series 7 before I file petition or is it ok to have the exam after receiving or reviewing the Visa application? The Company who wants to hire me is not H1B dependent and so they don't have to proof a shortage of qualified US Workers and want to file petition for me. 3.     Your company has a lawyer, and usually the lawyer gives you a list of papers you need to provide (e.g. your CV, if necessary translated copy of your degree, an official certification that your degree is equivalent to an US bachelor degree). The lawyer does the actual application. It is also their job to get the labor certification done in a timely manner. There is nothing you can do in this regard. Currently the cap isn't a huge issue at all. Filing for the FY cap started 1. April 2011. On 8/26/2011 there were 29,000 petitions, and 65,000 are available http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=4b7cdd1d5fd37210VgnVCM100000082ca60aRCRD&vgnextchannel=73566811264a3210VgnVCM100000b92ca60aRCRD Your security license is irrelevant for the H1B as such, but probably will help in your labor certification if they make this as a condition for applying to the job. So they can start the labor certification first, and should time it, so that when it's time to submit the actual petition you have it. It will probably take a while anyway to get all your paperwork together on your side. Make sure you talk to their lawyer so s/he gives you a complete list of all they need and not asks you piecemeal for one bit at a time. But you are not involved in the actual application. You just supply some information about yourself and your qualifications.
