What rights would I have as a EU citizen?

I am a newly-married British citizen moving to Italy. What are the EU/EEA rights of my American husband there?

  • My American husband has a '2-year leave of stay' in the UK visa in his passport. However, we have decided we want to move to Italy. As we are married, does my husband inherit the same rights I have to live and work in the EU under the leave of stay visa he currently holds? Where can we find out this information?

  • Answer:

Your husband can enter Italy without visa based on his American citizenship. After arrival he will need to apply for an Italian Residence Permit of a Family Member of an EU/EEA citizen. This can be done at the questura (District State Police office) or through certain Italian Post Offices (with Sportello Amico logo). http://www.poliziadistato.it/articolo/view/10930/ ..

He has a UK spouse visa. This gives him the right to live and work in the UK. It does not extend to other European countries. If he wishes to move with you to Italy, then he will need to apply for an EEA family permit.

From a practical point of view, once his two years are up he's eligible to apply for Indefinite Leave to Remain (ILR) & once he's held that for a year he becomes eligible to apply for British citizenship by naturalisation If you move to Italy he starts over again at the bottom - the residency requirement to become a naturalised Italian citizen is 10 years, you'd also need to check that they allow dual citzienship for naturalised citizens
