Can I use part of another artists work in my own work?

  • For example I have added a well known cartoon head onto one of my own drawings.I have seen lots of art work where the artist has used anothers work usually changed a bit. Andy Warhole used the work of other artists{ Marilyn Manroe} and recreated them.

    "INTELLECTUAL PROPERTY", remember this phrase as this is a huge thing now with the internet and the Chinese stealing artistic concepts since they don't have creative minds due to years of mind control under communisim......Here is the law: Anything an artist creates even if it is not officially copyrighted through the legal system is copyrighted under the intellectual property laws. That is why it is important to date your work. This has come up with musicians and their lyrics many times trying to prove who wrote it first. When I sell a painting technically the owner of the painting can't use if for a christmas card or anything else....the image is always mine. I however can use reproductions of my work, evenpieces I have sold to others, on anything and as much as I want. So to answer you question, technically NO you can not reproduce even part of a painting. But, just make a minor change in the image so people will get it but it is not really a copy. For example, give the guy big ears or a mustache or make him a black man....something different and then you are ok. good luck

You must also remember the aspect of Licensing when using part work of a fellow artist. if you intend to sell the work you have created with a portion of their creation, then you may have to pay them a gratuity for the use. I would advise to protect yourself to attempt contacting the artist or the organising that represents them to gain permissions to use the image. that way you have it on record that you sort out the permissions and if it is granted you have it on file should any attempt at prosecution for infringment of copyright be made. any artist or representing organision may give immediate permission or they may state costs for use of the whole work or part. there are however groups out there that give away art in whole or part completely free and there is currently an incentive for artists in the ul to send works they will not be using into a central point so that others can take them and do something with them. best bet i would advice on this is to seek out an artists exchange site or forum...it is better to ask before doing...it cuts the risk out alltogether.

Especially nowadays, borrowing and outright stealing from other artists is definitely allowed. However, making money off of a borrowing or stolen image could present problems.
