If a celebrity comes to my business and poses for a photo, can I use that photo in my brochure?

    The short answer is no. Photos of people may be used without permission in generally two situations. Editorial use (newspapers and magazines) and documentary use. Anytime a persons face or other identifiable portion thereof is used in a commercial way, a model release must be signed. While the photographer owns the copyright to the image, they have very limited rights when it comes to "publishing" that image. An image is considered published if it is printed, posted, used in the print media or in any commercial way.

You might want to check with the PPA on that. I believe you CAN use the image in your brochure or portfolio, however you canNOT sell the image or publish it. It would be considered part of your photographic resume. Best bet though - Contact the celbrity and get written permission to avoid any legal issue. Chances are they WILL give it.

Absolutely not - you would be using their likeness to promote your business and that would constitute their endorsement of your business. Any celebrity must be paid to use their likeness in any type of advertising campaign and they must authorize the use. You could face losing your business from the lawsuit that would be bound to follow if you did.

No. Taking the picture does not automatically give you publication rights - you need written permission.
