How long does a copyright last?

  • I am on a committee that is trying to raise money for a local museum. One project involves selling prints of photos in and around town. One committee member has come into possession of two original photographic prints that were done by a well-known local photographer about 90 or 100 years ago. She acquired them at an estate sale, so she feels that she bought them and owns them. Due to the subject matter, we are fairly sure that these are prints of which there are several copies. Due to the age of the prints, we are fairly certain that they were not registered with the copyright office, however we must allow the possibility that a copyright once existed. The question is whether or not it is legal for her to make the prints available for reproduction for sale or whether there might be copyright issues. Although the photographer passed away about 80 years ago, there are surviving descendants of the photographer still living in the area. I have the ability to scan and print copies, so gaining the cooperation of a third party is not a concern. I just do not want to do something that is not right. Can we just go ahead and make reproductions for sale? Are there copyright issues to consider that I am not thinking of? I would appreciate your thoughts on the matter.
