How can i retain proof that I obtained a Flickr image with the proper Creative Commons License?

  • I have sound some great photos that are listed as free for commercial use / free for derivative use. I want to use them to make some free WordPress blog themes to distribute online (for free probably). How can I cover myself in terms of proving that the images were legitimately acquired under the proper creative commons license. I dont want the original photographer deleting his photo from the flickr gallery and then disputing the terms under which the image was originally submitted. Is it possible to get some kind of certificate from Flickr? Or should I go through the hassle of trying to contact the photographer directly?

    As usual, a heap of stupid answers about copyright issues. The photographer has given permission for his photographs to be used. Why on earth would you contact him to ask him again? With regard to his possibly changing his mind after you've used his images, you really should ask Flickr. One way you could show that permission existed is to access that photographer's photostream, where the creative commons permissions icons below his photos are visible. Hover your cursor over the time at the bottom right of your screen and when the date shows up, take a screenshot. Save this and you have a record of the time and date when these permissions existed. This could of course be faked by resetting the calendar in your computer, which is why I suggest you ask Flickr's advice.

You always contact the photographer. Flickr has no say in this at all. It's not their photo, all they do is host the photos that are viewed on Flickr. If the photographer already gave you permission to use these said photos, then you are in the clear. It doesn't matter if the photographer takes their original photo off Flickr. You had permission while that photo was live to the world to use for commercial use. If you want to make sure you are safe then sorry, then contact the photographer directly asking for an agreement that you can use the photos.

Contact the creator photographer and get it in writing from him or her. That is the only way to protect yourself. Flickr is not the copyright holder and therefore can't grant you those rights.

You can start by contacting the photographer, directly. There is much about flickr's terms of use, and licensing that remain "unclear", to be honest. And as is common these days with usage rights being "blurred" by CC licensing and terms of use from the Corbis-like mentality of people looking to score an original image to use for their benefit, no one ever actually considers the person him or herself who actually captured the image. Because many of the people who upload their work on flickr don't do so for the benefit of people like you, nor do they read flickr's usage policy and rights - whether that is their fault or not, all the legal jargon aside, why not try to communicate your inquiry to the photographer instead of relying on creative commons to do it for you - indirectly? Any future or perceived dispute can be cleared up by contacting the photographer. If they are cool with you using the image, get them to email you their permission. That should be sufficient for what you will use the images for.
