Can someone help me by find out how's owner of this image?

  • I need to know any related url/link to find out where is originally this image come from. Ok, my story is like this. Before this i made some graphic artwork image for non-profit web site. That image originally i take it/download it after i search it at Yahoo.com & Google.com . After i done with my artwork and display it on my friends personal website, somebody come to with a "two barrel gun" and claim & give me a warning that image is under their copyright so i cant use it where it will be a conflict between two website. Personally and seriously i know that image/logo is not their under their copyright coz i know i'm not taken from their web site but i'm forgot where originally URL i take it. Therefor i wish if somebody here know who's the original owner with any URL link let me know it where i can come out with my "double barrel gun" and shoot them back. Here that image: http://www.geocities.com/xmielax/logox001.jpg

  • Answer:

If someone came to you and told you not to use...and they can show ownership...then it doesn't matter where you found it...the original creator may have sold the rights to that image and if that is the case, you cannot use it without permission regardless of where you "think" you found it. Either way, if they can show ownership, no court will side with you....ever. Never take an image to use unless you get permission first. That is like stealing from other artists and won't help your art career at all...plus attorneys love to sue into oblivion anyone who steals art work in any form....unless you can afford an army of lawyers, don't go there... Be an artist and create your own artwork...

It doesn't matter where you got the image from - they may have stolen it from these people, or they could have gotten permission to use it, that's between the copyright owners and the other webmaster/organization. The fact is, YOU took someone else's work, you used it without getting permission, and now it's biting you on the butt. Take the image - and any other images you took without permission - off of the site. You don't have a leg to stand on, and if you try to take them to court you're going to wind up in even bigger trouble than you're in now. When you are creating websites, you CANNOT just pop in random images you take from off the web. That IS a copyright violation, and while many copyright holders will let you use such images for non-profit / personal use, if they choose to tell you to take it down, you are legally obligated to do so. The exception to that rule is what's referred to as "stock" or "clip" art... and even with those, most of the original artists and photographers will tell you that you can't use their work to earn money without contacting them for permission.
