Can DISH Network's contract be valid if I didn't sign it?

  • I have completely lost all respect for the Dish Network company. I was simply calling to cancel services with Dish Network, however was given the run around. After several transfers, I spoke to a corporate representative. I was advised by this rep. that I was under a 2 yr contract and will be charged a $425.00 fee for cancellation. The main reason I called to cancel the service was due to lack of funds. Now, I am being told I signed a 2 yr contact that I was not aware of? I can not afford $24.00 a month, what makes this company think I can afford a $425.00 cancellation fee? I was not even home when the service was provided. I was then advised that whoever signed for the contact the day the service was installed would make the contract valid. Services were installed over the weekend, it is now Tuesday. I can't understand why I am being charged a $425.00 fee for cancellation and how anyone can sign on my behalf with out my authorization. Dish Network is sending me a copy of the "contract" for my review. What can I do as a consumer to cancel without being charged a ridiculous amount? How can a contract be legal/valid if I didn't sign it myself nor agreed to it? They make cancelling a big hassle so customers will stay and keep on paying. If customer service was really good, contracts wouldn't be necessary to keep customers from cancelling.

To read your post it would seem that Dish Network entirely on their own came to your home and installed their system with no input from you or anyone there. We all know that isn't true. If it were, how would they even know your name? So why don't you tell us the rest of the story that you left out? Why did they come to your house and install this system and who called them in the first place? Dish Network and Directv both have a very similar policy. This two year contract offer is because the install is a money loser for them and the only way for them to make this money back is if you have the service for at least 2 years. >Yes, I just made an appt. for a tech to come out over the weekend but I was not home nor able to cancel right away. There was someone home acting on your behalf (meaning they were not a minor), else they would not have been able to do the inside the house work. They do not do installs unless an adult is home. If you had changed your mind, you had an obligation to tell that adult to not allow installation. But you did not do this and instead you let them finish all their work. Now that the work was done, Dish Network has to pay their employee and you have that Dish antenna and the receiver and you have to pay for that. All the work has been done, like it or not, you have entered into a legally binding agreement with Dish Network. Do you think they do not have lawyers and a legal department to make sure these things are air tight? You can refuse to pay. It will get sent to collections and you will have a collector to deal with for the next few years. It will show up on your credit report for the next 7 years. I admit, it is a tough lesson and I feel for you because of it. However, you have not given me one tiny reason why this had to occur. You had chances where you could have corrected the situation, but you did not do so. So now you are stuck with the consequences. >WOW... get this, I called to try to work things out and found out they had the wrong adress. That's why it made no sense to me that "someone" had signed for me. What a bunch of idiots! Now, someone else is enjoying free SATELLITE... on me< GREAT NEWS (I guess?!) though I have to say, your entire post has been one of the most confusing I've ever tried to help. You do say you called a tech to make an appointment.... so what is up with that comment?? Or is this just a face saving thing you are doing here?

you should have waited to call them when you had the cash.and if you did call then you are responsible for the bill.it don't matter who signed the service contract since you are the one who agreed to have them show up and install it.so now its your decision if you keep them for the 2 years or cancel.and pay the fine.plus that months rental..

Sending a technician, giving you a new receiver, and sat. dish, costs money, which they need to recover. You should be angry with your friend/spouse who let them do the installation in the first place, not Dish. You haven't even paid them for one month and you are complaining that canceling is a big hassle!! Every time they talk with you on the phone they lose money!

I don't understand. When I signed up for Dish, the following was required: 1: The representative recorded the call of her reading the contract to me - including the package I was signing up for, that it was for 2 years and there was an early termination fee. 2: The representative recorded me saying I had been informed of the terms of the contract. 3: When she scheduled the installation date, she informed me that I or my wife HAD to be present. If the installation is at a rental property, the landlord must also be present. 4: When the installation was finished, the installer showed me that the system was operating and had me sign off on the installation contract. They were very up front about the monthly fee, the early termination fee and the 2 year contract. How did you not know about these? Also, how exactly did the installation take place if you weren't even home? The installer must have access to a TV inside your house. How did he do this without you being home to let him in? Who signed the contract if you didn't? Something doesn't add up here. Are you sure you're telling the whole story?
