Are we bound to a Dish Network contract if...?

  • A little back story. We recently got Dish Network installed. Big mistake! Before going through with the process we asked if specific channels would be included in the package we would be receiving, one being Nick Jr. We were told numerous times yes. Come to find out after the install we now need to upgrade the package. We were also told that the dvr would be able to record 2 live shows on separate tvs at the same time and still record. This is not the case as if you record something, it is defaulted to the main tv and you are forced to watch what is being recorded. We were told that there would be a 30 day, then a 7 day and then a 3 day cancellation period. This was a lie. So we recently wrote a letter. Well last night I start looking at the paperwork and there are 2 papers. One talks about the installation and the other about the terms. Now looking at this. I asked through chat on Dish Network since it can be emailed to me, if the installation agreement was just about the installation and the other about the terms, the actual contract. Was told yes and I asked if I didn't sign the contract then I am not liable. Was told that was true...so I called and spoke to customer service and was told the same thing. I was then transferred to the loyalty dept....and was told the same thing. I was then transferred to the exec resolutions dept. I again was told the same thing. It seems the tech did not have me sign or initial the actual contract, just about the installation. I was told that since I did not sign I would not be held accountable, but they had to get their copy. I asked specifically if what I have and what you receive shows any type of signature and or initials what happens then...was told well since you have your copy and if there are any changes it would be fraud. So today I wrote a letter and faxed the info to the exec resolutions dept. I hope to hear something soon. But that contract only has a few things on it...my name and address and the satellite position number that the tech put...I never filled out that form nor did I sign or initial. I guess I wanted to see what everyone's thoughts were or if they had similar experiences

    All Dish network programming is ON Line. Nickelodeon is with the basic package, but for Nick Jr. you need the 250 channels. If it was so important you should have checked it before you ordered. Yes, you can record two live shows on two separate TVs with a dual tuner DVR (put it in dual mode), so I don't see where is the problem there. In many cases there is no need for signature. When you put the order over the phone it is the same as signing an agreement, but I am not a lawyer, so you may want to consult one.
