Can i buy a DVR for Comcast on EBay and just hook up? Or do I have to pay comcast $9.95 a month?

trying to find out if the Comcast fee is rental of box or a svc fee. If I buy my own Motorola dtc6412, do I still need to pay the monthly DVR fee?
