Can I sue Microsoft for updating my computer, even though Automatic Updates is turned off?

I want to sue Microsoft for crashing my computer today (09-09-09). I also think I have a good case against them. I installed an update to Adobe Flash Player. 10 minuets later my computer reboots all by its self. As it boots it says “Windows was automatically updated and required a reboot of your system”, or something to that affect. Then suddenly, quite abruptly, the Blue Screen of Death. The computer was dead. It would not reboot again. I could get it to the Windows logo screen and then, Blue again. I had to reinstall windows, all my programs (Some of which I could not replace), and ALL my music, pictures, family videos, EVERYTHING. I used this computer to run my business (I own a recording studio, and everything is computer based). The crazy thing is this: I have Automatic Updates TURNED OFF!!! There is no reason for my computer to update ‘Automatically’. This means Microsoft hacked into my system, updated my computer, and caused it to crash. Is this not an invasion of privacy? Who, or what law gives them permission to eavesdrop on people? I hate microsoft because nothing of theirs works, and if you use another vendor for whatever purpose, they ‘punish’ you for doing so, by hacking your computer, and doing what they want. Can anyone recommend an attorney? My system: Windows XP Professional SP3 4 Gigs RAM AMD Athlon 64 3800+ 4 - 1TB Internal HDD 2 - 500 GIG External HDD More cooling than needs to be there

I hate to say this, but your loss is completely your fault. There were several options that you could have pursued before YOU formatted your computer. Did you attempt to log in using safe mode so that you could try to fix it that way? Did you try to do a system restore? Did you try using your Windows disk to do a repair install? That's just the obvious things you could have tried first. I'm sorry that you lost so much... You more than likely didn't have to. Try using Recuva to get as much as you can back... http://www.recuva.com P.S. Charlie is probably right. I've had no end to headaches caused by Adobe Updater...including crashes where I lost data. It's the root cause of many crashes and computers slowing to a crawl for no apparent reason, if not all evil.

No, you cannot sue microsoft, because it wasn't the updates fault. Your hard drive can crash at any moment. It could of been due to a virus, user error,or randomly. Just take it to the local shop and have them replace the hard drive. Besides, even if you did sue them? This is a VERY stupid thing to sue them for. You can youtube how to fix the blue screen of death.

You can try, but I seriously doubt it will get you anywhere. It was probably a third party program (like Adobe) that crashed your computer.

That really sucks, man, but do you really think you can sue Microsoft... one of the largest company's in the world!? I don't think any intelligent lawyer would even attempt such a thing. It sounds more like an Adobe update caused it anyways. Many times there are updates going on that users don't even realize. I know your pi** ed off, but I really don't think Microsoft would "hack" your system to do an automatic update - most of their updates are for their ease in dealing with MS problems :) Try a Safe Mode Boot (think it's F8 for your system), and attempt a system restore (hope it was turned on) to an earlier date. If that doesn't work, take it to your local computer shop - shouldn't cost more than $100 to recover your 4TB (why is that all internal?) HDD. Your external drives should be fine. I also have to say (and this goes for everyone reading this) that if your business is computer based, keep your main computer off line - break down and buy a cheaper one you can use as a "stunt double". Honestly though: I hope you can get it working alright!

No. You cannot sue Microsoft for this. They did not hack into your computer. If you indeed decide to pursue a case, please note that they have an entire legal affairs department that just cannot be dealt with petty issues like this one. Apologies for your issue.

I'm not sure you can sue them, there's probably some clause somewhere in the terms of agreement that says that if your computer crashes and you lose everything it's nothing to do with them, I know how you feel though, i have automatic updates turned off, but they try to get me to update all the time, like putting tiny text next to my shut down button stating that pressing it will update. It so annoying because if you buy something like a computer, YOU want to control it, not your operating system, or Microsoft, or anything else. They didn't hack you though, it's just Windows constantly trying to get you to update. Anyway i'm not sure there's any point suing them. They get sued thousands of times a second, but they win, because they can afford the best lawyers in the world.
