Business Idea involving computer programming.?

  • I have an idea to start a business involving computer programs. Do I need to hire an attorney to trademark this new business idea or patent it? I want to be able to speak freely about this idea but dont want anyone to steel it. How would I go about securing this idea legally?

  • Answer:

check the source for differences between them. I'm not sure your idea qualifies though..Are you trying to patent your business idea or an idea about a computer program that you are trying to create and market?

Once you turn your "idea" into an invention, you can file a provisional patent application for $125 and reserve your rights in the future patent while you confidentially shop your invention around for investors. The more people who know about your invention, the more competition you will have by the time your patent is issued (at least three years from now, if ever). You cannot enforce a patent until it is issued. Consider having an attorney help you with filing the provisional and with drafting a workable non-disclosure agreement for contractual confidentiality with potential partners or investors. Do some online searching for patents on similar inventions, often called "business methods", depending upon how specific the computer technology must be for your invention to work.
