Where can I buy an old phone booth?

Is it okay to buy the Blackberry phone a friend just received from his insurance?

  • Three days ago, my friend lost his Blackberry phone. He called T-mobile (his service provider) to deactivate the line and his insurance company to request a new Blackberry phone. The insurance company shipped him a new phone, but he had to pay $138. They said that if he happened to find the old phone, he could return the new one and get a refund. Someone found his old phone and returned it to him yesterday. He received the new phone today. My current and uninsured blackberry just messed up and I need a new phone. Is it okay/legal for him to sell me either his old or new phone for $138? If my friend happens to lose his phone again, will the insurance send him another phone? I wouldn't want to jeopardize his ability of receiving a replacement phone if he happened to lose his phone again and not find it. I know insurance plans vary, so I don't expect exact answers. Thank you
