Nobody is allowed to Tap your phone this applies to landline; cell phones use the airwaves which belong to everybody and may be freely monitored in some places so that is another level of legality with landlines for the police to tap a phone, legally, it will be set up at the telephone exchange. It will be done under the jurisdiction of a court order which will specifically list the telephone number or numbers to be involved and exclude all others. Personel of the phone company face criminal prosecution should they reveal any knowledge of any phone tap in progress, or taps that have occurred in the past. Any illegal taps could bring on Criminal charges ranging from theft of service to much more serious charges.Any evidence obtained by law enforcement as a result of illegal taps is inadmissable in court. The phone company may set up a call trace to automatically record numbers calling a customer reporting harassing calls ; in my experience this may take place in cooperation with law enforcement with the understanding the paperwork will follow promptly. In 1 case that did involve me where the paperwork was not provided the harassing caller had an unlisted number . Myself and my employer would face charges if this information had been provided without a court order authorizing same so i refused. the cops were ticked off but they should have followed through with the paper. Another colleague less concerned with legal issues gave them the info but he could have faced criminal prosecution and firing . In this day and age any phone taps set up at the exchange are virtually undetectable . wether or not a tap is there you won't know it until you wind up in court. If a family member were taping phone calls to monitor another's activities that might be noticable though that might be excusable under the law if that individuals name were on the account. however it is morally wrong and justification for terminating that relationship. Good Luck
