Can a BRAND NEW stolen pre paid cell phone be activated/flashed/unlocked?

I have heard everything about IMEI, ESN, and all of that, I know that if someone's personal phone is stolen, they can report it and have it bricked and made useless. My question is for NEW phones. Example: You go to a department store and cut open a pre-paid cell phone box, steal the phone, and leave. At this point, the phone is useless, it is not activated on a network (I'm assuming) Can you take that phone, bring it to some other cell phone store, and have the foreign guy at the counter activate the phone onto a network for you? How about if the phone needs a sim card, would they know that the phone was stolen from a store, if you bring it to another store? I am just curious, I'm not even sure how I got on this subject but after looking all over google, I was amazed that there is no info on NEW stolen phones.
