Can I apply ILR without any problem?

ILR and British citizen ?

  • Hy there I'm married to British citizen been together for 4 years I got my ILR and relationship break down she want divorce now my question is : as I'm traveling and I'm getting divorce will that be a problem when I'm coming back when they ask me and I say I'm getting divorce just 6 month after ILR and what about British citizen can I apply 12 month after the ILR if I'm separated any advice pls

    Once you have been granted ILR, you will not be questioned about your divorce when you try to enter the UK after a holiday. You will only be questioned if you hold ILR and spend a long period of time out of the UK (to identify if the UK is your permanent home). You can apply for naturalization (British Citizenship) after holding ILR for a minimum of 12 months and have lived in the UK for at least 5 years from the date of application. If you haven't spent too much time out of the UK in those 5 years and haven't been involved in criminal activity, then the divorce shouldn't be an issue.

Your right to remain in Britain was I expect dependent on your marriage. As the marriage has broken down / ended then I would hope that the Home Office would ask you to kindly leave or reapply in your own right.
