Will the US Immigration know that I received a police caution nearly 10 years ago?

  • I am flying to the US in july. I received a police caution nearly 10 years ago. This will have been erased from file by now. Will the US Immigration have knowledge of my caution? Should I just tick 'no' on the Visa Waiver regarding any convictions? I did not go to court and was not charged. Has anyone else been in the same situation, and just ticked 'no' on the waiver about convictions, and got through Immigration ok? Please help

  • Answer:

No court and no charge equals no conviction so your answer will be truthful. I'm not sure what you mean by caution other than you received a summons (ticket). If you did get a ticket and you answered for it and paid the fine (if there was one) you should be just fine. Not sure what the statute of limitations is for "caution" (summons?) but it depends on what you were cited for. Was the caution in writing or verbal? Who issued it? You probably have nothing to worry about. Add some detailed info to your question for more specific answers..

A warning is NOT a conviction!

I am not familiar with written warnings in NYC. Either you are charged with a crime or given a summons. There is a stop and frisk form that they will fill out if they search you for weapons or drugs. These forms by law can not be used as part of a permanent record. If the owner of the Pub did not wish to charge you with a crime. you are clear.
