NEED HELP GETTING MY GIRLFRIEND TO THE UNITED STATES FROM EL SALVADOR!?
-
Now that I got your attention, I need help from people that know about Visas and El Salvador/United States travel policies, but if you have any helpful hints on travel I would like all the help I can get. Ok so my girlfriend is 18 and just recently got her ID (more or less like a driver's license in the US, but without the legality to drive) and her international passport. Now that she has received both of those, the only things that stand in her way are luggage, plane tickets and the VISA. My family has the money to pay for the plane tickets and she has the luggage obviously (she is from a rather poor family, but better off than many other Salvadorans). Now, the visa I know will be the most difficult part of this ordeal. They people that will (hopefully) grant her the visa can think what they want, but all she is doing is coming up here (California) to visit ME, not to work, not to help family members cross the border, just to visit me. Now if anyone could give me advice to give her when being interviewed or the process of getting the visa, I would GREATLY appreciate it. She has the interview in one week so I need answers FAST. I love her so much and it would mean the WORLD to me to see her again. She's scheduled to come up her the first week of April, and last time I saw her face was in November. Any more time apart from her would devastate me!! Thanks for all the help! Peace, Weston

Answer:
It's going to be extremely difficult. An unmarried, 18 year old girl, traveling from El Salvador to visit her American boyfriend, honestly, will raise many questions, on which the burden of proving the opposite is on her. The US immigration system is based on the exact opposite principle as the justice system. In a nut shell, you're guilty until proven innocent. Here are some of the factors that will go against her: El Salvador is a developing country, and has a very high rate of immigration to the US, both legal and illegal. A large portion of El Salvadorians are in the country illegally, violate, or overstay their visas. To visit, she will need a B visa; a tourist visa, allowing her to stay in the US for up to 90 days for tourism or business only. - If the consular officer thinks she might stay beyond her visa, or violate her visa conditions, she will not be given a visa. - If the consular officer thinks she might be going to the United States to get married, she will NOT be granted a visa. - If the consular officer doesn't believe that she has enough finances to stay in the United States for the planned period, she will NOT be granted a visa. Basically, if the person in charge of granting the visa is in any doubt as to her intentions for traveling to the US, she will not be granted a visa. If I were her, I'd be honest about all my plans, when she plans to return, where she plans to stay, where she plans to visit etc. I would also tell the consular that she has a boyfriend in the United States, and maybe tell the office that she is planning a visit to the US, and then you plan a visit to El Salvador and so on. Make it clear that you are NOT intending to marry while she is in the US. Last, who will pay for her stay? The officer will ask her to provide proof that she has enough money to stay in the US for the period of time she'll be there. If she's staying at your house, a letter from you or the head of the household may be a good idea. Another good idea is for her to bring a copy of her latest bank statement, and any copy of your bank statement, where you state you are willing to cover some of her costs. Best of luck!

jhsm has some good points. Also, your girlfriend needs to know that the most important thing the consul that does her interview will look for is proof that she has reason to return to El Salvador. A business, school, children or other strong family ties that will assure him she intends to come back is the main criteria to be granted a visitor visa.

the solution is easy, a) marry her, or if you don´t want to, try forms b and c b) send her money to buy a ticket to Miami and desposit her enough money in a common account in a salvadorian bank, they have branches in Los Angeles, then she shows that account in the US Consulate in the VISA interview, therefore they agree her to come to the USA c) try to get her a job or create a compnay that requires her to come and work with you to the company, a lawyer can help you, the company has to show capability to afford her salary i hope you like my answer and choose it as the best one, best regards :-)
