What is the legal working age in Ontario?

  • We are from Ontario, Canada, and are moving to Alberta, Canada. We are hopping to take one of my friends with me. I am 14, and my friend is 16 as of January 19. She wants to go to a school there in Alberta, which means she would be under our care and watch. We are not sure if her parents would agree to this....but we are working on it. I was wondering if she can leave without parent consult..and come and live with us..without court or papers or anything...either we need the parents consult and we can take her.....or we can do what we are hoppign to and take her with us because she is of legal age. All we are wondering about is if she can come with us as legal age.. Thanks for you help!!

    The "Age of Majority and Accountability Act" for Ontario (1990, Chapter A.7) outlines that a minor is anyone under the age of 18 and as such your friend is NOT old enough to move out without parental consent in Ontario. If she goes with you or if you just take her then your family is opening itself up to kidnapping charges.

Your friend is not 'legal age' - the minimum age considered 'legal' in Canada is 18. If your parents take her without her parents' consent, they could be charged with a criminal offense.

At 16, a person can legally declare where they wish to live, and even leave home, without their parent's consent. Many assume it is 18 or 19 (age of majority), but it is actually 16. Your friend would be fine, although I highly suggest getting the parents in on this - just to make things better.

In fact, she isn't of legal age. She is still a minor and needs her parents consent.
