How does immigration positively affect Canada?

Fear of entry into canada-please advice?

  • I am an indian and had unfortunately been involved in a domestic violence 3 situation and convicted for the same in the USA an year ago. I had paid the necessary fine required by the USA court but was asked to attend DV councelling sessions for 18 weeks. After attending the same for 10 weeks i lost my job in USA during the recession and had to come back to India as i would go out of my visa status which i did without informing the court. Now i got a chance to travel to Canada. I heard that due to IRPA, any criminal issue could be tracked by Canada as well. Could you please kindly advice if it would be advicable for me to travel to the canada with my work permit? Would i be stopped at the port of entry? I dont want to take the risk of getting caught at the canada POE. Will my arrest record in USA affect my entry into Canada.I dont have any entry on my passport regarding my crime record. Is there a way the immigration officer in canada know about me at the poe? Please kindly advice if i can accept this assignement.

I can't say if you will be denied entry but I can tell you that a check of the system will reveal your charges in the US and, I suspect, will be a cause of concern for the CBSA agent. I'd have return airfare ready just in case.

Your passport will be scanned and your criminal record will show up. You will be denied entrance. It you wait 5 years or may, you may be able to apply for "rehabilitation" and be able to enter Canada.

First, you can`t enter Canada with a US work visa. Second, in order to enter Canada from India, you need to apply for either a visitor visa or a work visa at a Canadian embassy in India. You will be asked on that form if you have every been convicted of a criminal offense -- and they will check it against their records, those of India, the EU, and the United States. And of course, lying carries a five year jail term in case if they somehow miss it and find out later. Third, you can`t apply for a work visa in Canada unless you are in a qualifying degree and have already been offered a job by a Canadian company. You also apply in India and they also do a criminal background check. Forth, even if you (somehow) managed to slip through... lying on your application is punishable for years in jail and of course being kicked out of the country. The immigration officer will know because you don`t have a visa. And you won`t get one with a criminal record.
