How can i enter canada with dui?

  • im planning to travel to canada soon and i heard that it would be a problem because 5 years ago i convicted in dui when i was on vacation in california. i have israeli passport which mean that i don't need visa to canada. will i get a problem entering to Canada? and if so what can i do to fix this situation? thank you so much for your help!

Operating a vehicle under the influence of drugs or alcohol (OUI or DUI) is considered a serious issue here, and can render you inadmissible to Canada. The question is really whether they can see the conviction or find out about it at the CBSA. I doubt that Israel shares its criminal records with Canada, but if you are travelling on the same Israeli passport as you did five years ago, your name and the conviction may show up on the records that Canada Border Services Agency (CBSA) shares with US Customs and Border Protection (CBP). If so, they will see that DUI and it MIGHT cause you a problem. But here is what would happen. Let's say that they see the DUI. If it was more than five years ago and the only conviction they see on your criminal record, they may consider you "deemed rehabilitated". On the other hand, if they do not, you may get here and they tell you you are inadmissible. What you do is ask to see a supervisor. You then discuss with them your options. You ask if you qualify for "rehabilitated" status. What that involves is that you submit an application to Canada Immigration (they can do this for you on the spot), and pay the application fee, usually CAD$200. The person in charge looks over your criminal file and either rejects the application, or approves it. If approved, your records from the past convictions no longer are considered when deciding if you can enter the country. And only that one 5yr old DUI? Odds are good you will be approved. Essentially, this $200 fee is designed to say "See Canada? I am willing to pay to show that I will not do these crimes while in your country." Now you can try to do this after you arrive here, but that can get complicated and if they do reject you, you paid for a flight and possible hotels for nothing. After many years, and with no other infractions, you may be "deemed rehabilitated." However, I'm not sure 5 years is enough. You will need to contact a Canadian embassy or consulate, or the Canada Border Services Agency.

That would become a problem for you! but plan things accordingly. See an Embassy personnel to assist you with your queries about Dui in Canada 5 years ago. There is a possibility of getting in and at the same time denied of getting in. Just be patient =)
