How can a Balikbayan become a dual-citizen?

  • I am an American citizen born in the Philippines. About a few weeks after I was born, my mother had me become an American citizen. [[At the time my mother was still a Filipino citizen]]. Then we moved back to the states for 13 years, then we came back here 3 years ago and we are still here in the Philippines. In my passport, the philippine arrival stamps say Balikbayan. What process do I have to go through so that i can become a dual citizen [[Filipino, American]]. BTW im only 16;

    You ARE a Filipino by birth (born in the Philippines). Your birth certificate will attest to this. Secondly, your mom was Filipino at the time you were born. Get your birth certificate on NSO security paper and additional documents* and apply for a Philippine passport. http://dfa.gov.ph/?page_id=64 If ever you leave/enter the country, use the Philippine passport. Use you US passport to leave/enter the US or anywhere else.

Balikbuyan visas are only good for one year. So technically you are an American citizen in an overstay status. Shame on you mom for not taking care of this. Now your going to need a lawyer and $'s to straighten this mess out. BTW it costs in visa fees and fines P22,500 a year x2 at least so hope you have some money stashed. At 16 you are not legally an adult and cannot change your citizenship status. Thats something your mom needs to handle being your parent and legally responsible for you until you turn 18.

You have a privilege carried by few, but you have to "hurry". First, you are not saying anything about your present status with the Immigration authorities. A Balikbayan visa is normally valid for 1 year only. I suggest you go (with your mum or authorised adult rep.) to Immigration office in your town soonest possible and apply for dual citizenship. They will guide you accordingly. Do not accept help form any "fixers" that may roam around the area.
