Can a drunk guy commit rape? Yes or no?

  • A plain old self explanatory question. Because of many instances that were reported on the news about people committed rape under the influence of toxic substance. Under the influence of drugs that is possible. But intoxicated by liquor, that is completely impossible. I ask this in the Philippines section because I believe any Filipinos and some nincompoop has a tendency to become a lawyer. It is too evident in the present impeachment trial of CJ Corona with the prosecution team of lawyers, one who would ask for a toss coin on what to start with their charges and one who would cover his ears not to hear evil. Let us play the role of plaintiff and the defendant, I will defend the guy who is charge with rape while you play the role of prosecution. If you say yes, a drunken guy can commit rape. My next question is how? A person intoxicated by liquor has no clear understanding of his surroundings nor could tell what is right and wrong. How much more to have an erection. A drunken guy would only love two(2) things upon arriving home(if he can arrive in one piece), one is the toilet to vomit and the other one is the bed to sleep. A drunken guy cannot even stand up straight or walk in a straight line. Speaking through experience, a person heavily intoxicated with liquor cannot have a hard on, the only thing he will have a hard on is by hand manipulation by a woman but that is not a guarantee that the erection will sustain its rigidity. Kaya nga meron kasabihan sa Tagalog "lokohin mo na ang lasing, wag lang ang bagong gising". One can slap a drunken guy and get away with it or rob him of his wallet. So how can a guy like this commit rape? Anyone with a lawyer instinct or presently studying to be a lawyer? If a guy comitted rape then he is absolutely not drunk and normal as anybody else. Just a curious question.

Under the law: "Penetration, no matter how slight, is significant to continue the offense". The influence of an intoxicant does not excuse or prevent the act of penetration. If a man penetrates, attempts to penetrate, or forces his sexual will on a woman against her will, he is guilty of a felony, will be found guilty, and sentenced under the law. AL

Yes, guilty of rape no exceptions. However if a person were under the influence of drugs, alcohol or mentally deficient punishment would be less severe than one who premeditates that kind of crime.

I heard over the radio about rape, yes, even when there was no erection but his penis had contact with the vaginal outer layer and he had committed it while conscious. He can also be charged of rape, or even a woman be charged of rape when they are the ones that commanded that an act be performed forcibly on a woman.And if it had a consent from a female but she is legally underage, there is also the commission of rape-statutory.

By law in the Philippines, rape is committed with contact by the genitals to the victim. No erection required. Just so everyone here knows. Drunkenness also, is either a mitigating or agravating circumstance depending on the circumstances. I think if you got drunk with the intention of raping someone, then its definitely aggravating.

Drug and alcohol intoxication can be used as defense to negate only the specific INTENT in specific intent crimes (eg, premeditated rape). But the act of rape still happened, so the rapist is still culpable, but the weight of punishment may be lesser compared to when intent is present. But if the victim is la coquine (ewww, as if someone would want to rape her in the first place), it would really just be a misdemeanor, and the rapist can get away with a slap on the wrist. And LOL at the questioner's thumbs down! Sounds like you raped someone while drunk! You'd better hire a damn good defense lawyer. LOL
