Is it legal for a 16 year old to leave home at the age of 16 without Parents consent in SA?

Hi, I am 16 years old, I wanna leave home and move to Cape Town, to get on with my life, I have no future where I am now, and my career is awaiting for me in Cape Town. The longer I wait, the more my dreams will take longer to accomplish. My best friends all live in Cape Town and my one best friend and I want to move in together so we can work and get on with our career together (what is: performing (band) and business (I already now own an online business what earned me R48000 in 3 months :) (so money isn't the issue, the issue is that I have parents who don't understand.. So, if I leave home at age 16 without parents approving is it legal? If so, Can i apply for my education without my parents (obviously they will contact my old school,etc.) Thanks Regards

R48k? I call bull on this. My friends have a band but they all have jobs/studying. Dude if you up and go then the parents will call the police.16 is not an age when you think logically (not calling you dumb-just maturity).

well firstly 48K is probably what your parents earn in one month (if they both work and have fairly decent jobs). Now remember when you leave, you need to find a place where you will be paying rent. Add to that a full deposit (in real life life that means paying double your first month's rent upfront). Then there's water and electricity, phone bills, service provider bills, medical, food and you may need clothes from time to time. There are school fees, transport fees (cos you're still too young to drive). Are your friends lucky enough to have 48K to chip in or are they gonna be riding your back for the money? Also keep in mind that one month when your friends haven't been able to come up with their share of the money, when one of you has had to get expensive medication,and your company goes through a slump. Besides barely scraping by, you may end up friendless - let's face it, 16 year olds argue over meaningless crap. My advice: Stick it out with your parents. Get an education that they pay for. Grow up and take the little bit of crap they give you, cos its really nothing compared to the real world. And yes its illegal for you to live on your own without the courts approval.

If your parents do not know that you have left home, they can become worried for your safety. They can call the police and report you as a missing person. If they believe you have "run away from home" they can apply for you to be put into the custody of the court as a minor. Going without your parent's consent will be very irresponsible. Try to talk it out with them. Bargain. Ask for their support. Ask them what they would have done if they were in your shoes. Your parents will fear for your safety, a sign that they love and care for you. Not that they want to be mean and nasty. A 16 year old without a guardian in Cape Town is risky. Ask your folks if they know of someone who can be a guardian for you in Cape Town, perhapy one of your friend's parents. Doing this without their permission is going to make things difficult for them. Talk to a teacher or an adult that you can rely on for support and ask for their advice. You would be in a better bargaining position if you carry on with school and save more money from your business to get a more solid start in Cape Town. R48000 is not a lot to live on and start a business, especially if the business is costing money before it brings in any money, if you are successful. Take care. Things can change in a year, parent's attitude also.

You would need a guardian to get you into school, find a place to rent etc I don't think it is legal without your parents consent, as far as i know the legal age is 18. I thought the same way at 16 and i am so glad I didn't move out at that age

You can apply at the high court which acts as the guardian of minor's in the last resort to apply for emancipation, or even majority status, which would allow you to run a business enter contracts, pay for schooling, enter into a leese agreement. Good luck!
