Al-Obaikan, a member of the Council of Senior Islamic Scholars and Advisor to the Ministry of Justice, in a statement to Al-Hayat Arabic daily on Dec. 22 said he has found in his recent research on women’s travel without mahram that it is “permissible” in Islam for a woman to travel alone without being accompanied by a mahram only when she feels secure. Al-Obaikan first published his views in his website saying a thorough research on the subject has made him satisfied that a woman can travel without a mahram or without the consent of her male guardian if she feels that she is secure. Several Shoura (Consultative) Council members and businesswomen have felt encouraged to act on the fatwa issued by Sheikh Al-Obaikan. Shoura members have favored an open discussion on the issue in the Council. “It is a very important step to begin with. If we can remove this obstacle, our movement will become much easier,” said Aziza Mansour, businesswoman and owner of Aziza Mansour Company for Real Estate. “I need to travel several times a month, but every time I need to take permission from my husband’s brother as my husband died several years ago,” she said. “The existing regulations on women’s travel make my business trips difficult and it delays several of my business deals,” she added. Mansour has called upon the Shoura Council to remove this obstacle and put a system that allows women above 35 years or so to travel without requiring consent from her male guardians. Dr. Talal Al-Bakri, chairman of the Social Affairs Committee in the Shoura Council, hoped that the system could be discussed in the Council. “I will be the first to vote for it,” he said. Al-Bakri added that Sheikh Al-Obaikan has been requested to discuss his views in the Shoura Council meeting. Dr. Sadaqa Fadel, chairman of the International Political Relations Committee in the Shoura Council, also said he would vote for the new proposed regulations on women’s travel when it is put for vote in the Shoura Council. An academic has also advanced the cause of having a system allowing woman to travel without a male guradian if she travels by air and there is no khalwa (close proximity) between her and other men in the flight. “This fatwa allows women to travel without consort if she makes sure that she will not be seated next to a man,” said Dr. Ahmad Al-Sheaibi, professor of Islamic sociology at King Saud University in Riyadh. There are dissenting voices as well. “The fatwa is not acceptable at all,” said Hissa Own, political writer and chairperson of Al-Bidaia Holding Company Group, the first Saudi company owned by a woman. “A woman can ensure her safety onboard, but not after landing and arriving in the new destination,” she argued. “Although I am a businesswoman and I need to travel to several countries, the consort system never bothers me,” she added.

    It does not matter what Muslim women want today, we shouldn't go against ALLAH(subhanna wa ta'ala). We don't know better then ALLAH(Subhanna wa ta'ala). It's just trouble causing "modern feminists" Muslim women who don't seem to like the laws set forth in the Qur'an and Hadiths of Muhammad(Salla Allahu Alhai Wa Salaam) who want to act like ALLAH(Subhanna wa ta'ala) astaghirfullah and change HIS laws for our protection and society's protection to suit their own needs. If you don't like the laws of ALLAH(Subhanna wa ta'ala) that he sent down for mankind and society, then don't be a Muslim and don't work in business. You can be a business person without traveling. Actually in my opinion as a woman, women aren't really suited to business operations as it's not in their natural nature. Financial issues are more related to a man's understanding then a woman's. For example, if I ever mange to Insha ALLAH open a mission/international Islamic school if ALLAH(Subhanna wa ta'ala) gives me the life to do so, then I will, but I'll let my husband deal with the business part, or let my little 21 year old brother-in-law do it for me, as I would probably mess everything up. I will put everything in my husband's name to make everything legal.

I dont know.. I quickly read the long question( not really a question) but anyways.. I and many 100 or so other women friends I have here in Saudiarabia.. We all travel without our husbands, brothers, uncles, etc.. I think this is all jibberish on paper to make someone happy.. I dont know. But we women have been happily doing our business and going about without having the need for chaperones.. I come and go to America several times without any male accompaning me.. Several of my friends and sis-in laws also... One is even a business owner and she travels a lot... Oh well...

Islam is based on the Koran and Sonna and this applicable at all times and places. No scholar is has any authority to make a fatwa to change these teachings. Islam is the way of life chosen and charted for Muslims by Allah and further clarified by our prophet Mohammad (PBU). This path of life works well for a balanced Muslim society. Any scholar who thinks he knows better is way off line; as Allah knows best. Those scholars who are acting in such manner are upsetting this balanced Muslim life; they have done this mainly for political reasons and personal gains. It is very obvious that Islamic teachings are working well in Muslim societies compared to other societies who do not apply Islam and have their share of social problems and illnesses. In these societies woman who roam freely are abused as they are left as victims to men who take advantage of such open opportunities. As a Muslim man I would not put my wife or any member of my family in such a situation. I would rather be there and defend my women. This blind imitation of the non-Muslims is what we have to watch otherwise we will end up like them, God forbid.

a fatwa gives some sort of direction to the people who wish to get sort of a moral "green light" to allow women to travel etc etc. all was banned under the name of religion, now it is time to start letting the people that 2 wrongs dont make a right. we can probably fix things up little by little. within saudi women travel alone often for business , work or family purposes. leaving thec ountry will be the issue that still raises a problem.

This is a rather long question. Just what exactly is a fatwa? Isn't that like some underground agreement to kill an enemy or the group members band together and have a fatwa against some common enemy? Isn't there a fatwa against the West?
