Is the judicial branch the weakest?

Isn't the Executive Branch and the Legislative Branch supposed to override the Judicial Branch?

  • if 2 branches of government say we want this health care law why can 1 troll the judicial branch override 2 huge elected branches of government' that doesn't seem right ot me an its seems like recipe for disaster because 1 branch can always say no and limit the function two other branches that agree on something who agrees with this judicial supreme court is overrstepping there bounds by looking at this do ur job an if 2 branches theres a split decision judcial get involved

That's not how the Constitution works. Each branch checks the other and has its own role to play. Legislature makes law. Executive enforces law. Judicial interprets law. The three branches don't work in a democratic system where majority wins or something. If a law is unconstitutional, it's unconstitutional. It's the Supreme Court's job to decide that. It doesn't matter if the President and Congress go "nuh-uh!"

Completely disagree. The Supreme Court is doing exactly what it was designed to do. If the legislative body doesn't like the decision, they can start the overruling process with a constitutional amendment.

*FACEPALM* Do you really not know what separation of powers means? For the President to insist that the Court uphold a law because it was enacted by Congress is to reject everything that separation of powers was meant to protect. The Supreme Court has been overturning congressional acts from its inception. Its job is to ensure that Congress and the president act within their constitutional bounds, not to rubber-stamp whatever they do. That’s not “judicial activism.” It’s upholding the law.

I guess you've never heard the phrases "THREE co-equal branches of government" or a "system of checks and balances". NONE of the three branches of our federal government has the authority to "limit the functions" of the other two. Does the president "limit the functions" of the legislature when he vetoes legislation? I started learning about this stuff in 4th grade. I guess you go to government school, huh, dipstcik? You have my sympathy for that.
