Help with magistrates court case?

  • I was assaulted and i pressed charges the case goes to magistrates court on the 22nd march. is it too late to drop charges also do need to go to court?

    The matter is now in the hands of the CPS. It is not up to you whether or not it continues. You had better turn up and have a word with the prosecutor. You don't say why you want the charge(s) to be dropped: if you have been receiving threats, then this is something which the prosecutor can deal with.

The decision to drop charges is not yours. Criminal charges are brought by the Crown, not the victim. If you look at any paperwork you've received, the case will be cited as "R. vs Smith" - R being short for "Regina", the Queen. The only person who can drop the charge is the CPS lawyer handling the case. (CPS - Crown Prosecution Service). You can tell him you'd like to have them dropped, but he's already invested time and effort into this case, so he probably won't. Also, if you've received a witness summons to go to court then you must go. A summons is an order, not an invitation. If you ignore it you can be arrested for contempt of court. Richard
