Can a minor get in trouble for being out past curfew with their older sibling?

I thought that a minor could be out past curfew as long as they were with someone older than 18. I never got in trouble for being out past curfew when I was younger. I am 19 and last night I got pulled over with my 12 year old sister and her 15 year old friend in the car because I turned around in a school parking lot after I got lost. The cop told me they were out past curfew and he could give them a ticket even though they were with me. He told me they could only be out if they were with a parent or guardian but i was just wondering if that's true or not or if he was just saying that because he was being a jerk.

Depends on the city, county or state that put the law in place. In some places, yes. In some, no. But in your case, it's likely the cop is just being a jerk. Otherwise he would have actually given you a ticket. The reason that he didn't is because he would have lost in court and looked foolish.

I would think you being with your sister is fine but not your sister's friend that's probably what got you in trouble. But definitely if you got lost you shouldn't get a ticket.

Different places have different laws. Especially in the summer time. But yeah in most places its supposed to be out past midnight with a parent or guardian. Police act that way because most crimes happen at night and if kids are hoping around and such they could get wrongly accused or caught in a crossfire. Ya know?

Don't know the state nor the city, so let's analyze this from a personal perspective. I doubt the law states that a minor is only permitted out after curfew with a legal parent or guardian. If that were the case, then grandparents returning home from the movies would be in violation since they are not legal parents, nor legal guardians. As for the legality of any adult supervision, that is dependent upon the parents to give. Whether your parents gave YOU permission to supervise the minors after curfew, whether the parents gave the grandparents permission, or even if the parents gave the neighbors permission, they are still adults with parental permission, either implied or specific, to be accompanied after curfew. To give the cop a break, I will ASSume that he's a rookie that doesn't know all the nuances of the law yet. I find it interesting that he THREATENED the penalty of a ticket without actually issuing one. Sounds more like a power trip for such a trivial matter.

Short answer: The cop's being a prick. That said, what he said might be at least partially true. It depends a lot on your local laws. Most cities don't actually have a curfew. They're on the books, but unless someone does something incredibly stupid, nobody really enforces something as old fashioned as that. I've actually only heard of curfews being enforced in a few cities in the Southern USA. In cities that have a real curfew, a minor can be out past curfew, with a parent or guardian, or a PROXY of the parent or guardian -- ie. this person's got permission from Mom&Dad to look after those kids. A situation where this would apply is if there's a class trip (the teacher or volunteer parent chaperon) or someone's baby sitting -- that's kind of your situation. A signed and dated note from the parents with a contact number is usually enough for authorities. The note should mention you by name, and the fact that they've granted permission for you to look after the kids for a while (using the word 'babysitting' is optional). That establishes that this person is taking responsibility as an adult for the well being of those children, AND that this is acting as temporary guardian, not some sicko kidnapper. It's what customs agents require at border crossings, so if it's good enough for federal authorities, it should be enough for an anal retentive police officer.

When I was younger, I would always go out with my older sisters. I thought that it was legal if you were with siblings. However, once I saw what you said I went and looked it up. On a website this is what it said about curfew: Almost all juvenile curfew laws identify exempted activities or exceptions under which juveniles may lawfully be out after curfew. These exceptions will vary by jurisdiction, but typically include: Minors accompanied by a parent or guardian Minors traveling to or from work Minors attending official school or religious events Minors running errands under an adult's instruction Emergencies I guess the cop was right, but I feel like if a juvenile is out with an older sibling it really isn't that big of a deal. I would still call him a jerk though!
