Where do I stand with Vodafone contract?
-
My dad has had a contract phone with Vodafone for over 10 years. Last week they phoned him offering phones for myself and my partner (we live with my dad) on his contract as he is a good customer. My dad said if we could pay for them then we could have them and asked the adviser to speak to me about it. The adviser asked what phone I had and what network I was on and if I was happy with them. I said I was very happy as I got a great internet deal with O2 and I only paid £10 a month. The adviser said he could offer me two blackberry phones for £10.50 each per month. These would include 200 any network mins 500 texts 250mb internet free blackberry internet unlimited vodafone to vodafone minutes. I thought this was a great deal and worth changing network for. I agreed to the deal and my dad then spoke to the adviser who confirmed what he had offered and my dad accepted it and paid extra for postage of the phones. We have received the phones which are great and we love using them. However, we have now found out that Vodafone aren't giving us the deal they offered. They are instead charging £15.50 for each phone per month and are not including the free Vodafone to vodafone minutes. As this is not what we agreed to my dad rang Vodafone back and explained the situation. After spending an hour arguing with him and basically calling him a liar, they finally agreed to go into their records and listen to the original call made to us by the adviser. They then said that the adviser should not have offered us this deal and that they couldn't afford to offer us this. As we had already started to use the phones as we didn't know we weren't getting what we had been offered, vodafone told us to keep using the phones while the issue was sorted and they would refund the usage. They said they needed to pass this over to their legal department and would be in touch within 7 days. Basically, I'm wondering if anyone knows where we stand with this? Do Vodafone have to give us what they offered or can they make us pay the higher price which includes less stuff?

Answer:
They made the offer, you accepted. This counts as a contract. Vodafone should honour this contract for the period they gave (12/18/24 months etc). If they come back and say they are not going to then your father needs to get proper legal advice.

It is a binding contract, Vodaphone have to stick to it. But under the Distance Selling Law you can end the contract at no charge to you.
