Will a deferred adjudication show up on a FBI background check?

  • I made a stupid mistake when last year and received federal criminal charges. I was allowed to enter the pre-trial diversion program, meaning that I after I complete 150 hours of community service (I have 20 left to do), and pay a fine (which I've already made full payment on), the charges will be dropped. I just graduated college and received a job offer for a great position. I have to get an FBI fingerprint background check, and I'm nervous about what may show up. When I filled out my app, it asked if I have ever been convicted, which I haven't, but I'm wondering if my charges and the fact that I'm in the program show up in my background check?     It depends on the background check. If your application only asked you about convictions, then I would imagine that the background check will only look for convictions. If you are ever asked about arrests, then you should expect the employer will be running an NCIC check. This is a background check that will identify every arrest. Fortunately for you, it is expensive for employers to run this type of test so only jobs that require security clearances will require this. Because you have not been convicted you enjoy the presumption of innocence. You should be fine, but if I was you I would hurry up and bust out those last 20 hours of community service. Get a period put on this as quickly as possible and get your criminal case file closed.
