Can you sue a high school for loosing your transcripts?

  • I am trying to get my transcripts from my high school transfered for college. The school claims they don't have transcripts and that they were all done by hand of course 15 years ago and now they have no record of me ever going to the school.     Yes, you can, but as in all tort actions, you (your attorney) must prove: 1. The school had a duty to retain the transcripts. (easy) 2. The school breached that duty. (easy- evidenced by the fact that they don't have them) 3. Their breach of duty caused you damage. (in this case, your ability to go to college). You should quantify that in terms of dollars. If an attorney is too unsophisticated to think outside the box and represent you, you could always sue the school district in small claims court by yourself for a maximum of $5,000.

If you want, you can sue anyone for anything. In civil matters, you could sue the school for having a roof, or your neighbor for being a different religion than you. Legally speaking, they were only required to hold the records for 7 years before they were legally allowed to destroy them. That doesn't mean you can't sue them, just that you probably won't win the case.
